Terms of Service

Effective: November 1, 2025

1) Agreement to terms

By accessing or purchasing from premiersouthshop (the “Services”), you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Services.

2) Eligibility & accounts

You must be 18+ (or the age of majority where you live). Keep your credentials secure; you’re responsible for activity on your account. Provide accurate information and keep it current.

3) Orders, pricing & payment

You authorize us and our payment partners to charge your selected method for product totals, taxes, and shipping. We may cancel or limit orders for availability constraints, suspected fraud/abuse, or errors; cancelled orders are promptly refunded. We may correct obvious pricing/content mistakes—even after submission—by cancelling and refunding or by requesting your instructions.

4) Shipping, title & risk of loss

See the Shipping Policy for timing and options. Title and risk pass to you when we hand your shipment to the carrier.

5) Returns & refunds

Handled by the Return & Refund Policy above.

6) User content (reviews, photos, Q&A)

By submitting content, you grant premiersouthshop a non-exclusive, worldwide, royalty-free license to use and display it in connection with the Services. Do not submit unlawful, infringing, or harmful content.

7) Prohibited conduct

No illegal activity, malware, scraping, service interference, IP infringement, impersonation, harassment, or deceptive practices.

8) Intellectual property

Except for user content, site materials are owned by premiersouthshop or its licensors. You may not copy, adapt, distribute, or create derivative works without written permission.

9) Disclaimers

Except as expressly provided in our Warranty Policy, the Services and products are provided “as is” and “as available.” We disclaim all other warranties, express or implied.

10) Limitation of liability

To the maximum extent permitted by law, PREMIERSOUTH PROPERTIES, LLC will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, or goodwill. Our aggregate liability will not exceed the amount you paid for the product(s) at issue.

11) Indemnification

You agree to indemnify and hold us harmless from claims arising from your misuse of the Services or violation of these Terms.

12) Changes

We may update these Terms and/or the Services at any time. Continued use after changes take effect constitutes acceptance.

13) Governing law & venue

These Terms are governed by the laws of the State of Florida, with exclusive venue in Bay County, Florida.
